Welcome to StyleBox. Fashion operated by StyleBox, Inc. ( “StyleBox” or “Company”). StyleBox is the operator of the StyleBox.us site, developer and operator of the StyleBox mobile application.

StyleBox is a fashion service that provides complete outfit in a box hand-picked by our professional stylists from renowned, high-quality brands at affordable prices.

The Terms of Use set forth in this agreement between you and StyleBox Inc shall govern your use of the products and services we offer through our website and applications.

This agreement provides important information to you, including information about your obligations about your content, our limitation of liability to you, and your agreement to resolve any disputes by individual arbitration and to waive the right to participate in a class action.

By accessing, browsing or using this Site or the App, you acknowledge that you have read, understood and agreed to be bound by these Terms of Use (the “Terms”). If you do not agree to these Terms, you should not use or access this Site or the App. StyleBox reserves the right to revise these Terms at any time by updating this posting. You are encouraged to review these Terms each time you use the Site or the App because your use of the Site or the App after the posting of changes will constitute your acceptance of the changes. By agreeing to these Terms it also constitutes your agreement to the StyleBox Privacy Policy (the “Privacy Policy”), which is incorporated herein.

We grant you a personal, limited, non-transferable, non-exclusive license to access and use the Site and the App. We reserve the right, in our sole discretion and without notice to you, to revise the products and services available on the Site and the App and to change, suspend or discontinue any aspect of the Site or the App and we will not be liable to you or to any third party for doing so. We may also impose rules for and limits on use of the Site or the App or restrict your access to part, or all, of the Site or the App without notice or penalty. Your continued use of the Site and the App will constitute your acceptance of any such changes.

1. Definitions

The following definitions apply in these Terms of Service:

“We“ or “us“ refers to our company, known as StyleBox Inc; our Website; our Service; depending on the context in which the word is used;

“Service“ refers to the services that we provide through our Website, including our styling and apparel selections, the Box, and the Website itself;

“Box“ refers to a shipment of clothing items selected by us and delivered to you;

“Website“ or “Site” refer to our website, which is located at the following URLs: www.stylebox.us

“User“ and “You“ refer to anyone who uses our Website.

“App” and “mobile app” refer to StyleBox mobile application.

2. Use of the Site and the App

You may use the Site and the App only for your own noncommercial personal use and in compliance with these Terms and Conditions. You are responsible for your own communications, including the transmission, uploading or posting of information to the Site or the App and are responsible for the consequences of such communications. Any other use of the Site or the App requires the prior written consent of StyleBox. You may not otherwise copy, modify, or distribute the contents of this Site or the App without the express written permission of StyleBox. You may not modify, publish, transmit, participate in the transfer of, sell, create derivative works from, or in any way exploit any of the content found on the Site or the App, in whole or in part.

3. Registration and Passwords

Although you can browse our Website to a limited extent without registering, in order to engage the services and make a purchase, you must register an account.

To register,

  • You must be the minimum age required to enter into a contract in the area in which you reside and, in any event, must not be less than 14 years old.
  • You must register using your real name.
  • You must provide us with personal information, payment information, and other information that allows us to provide you with our Service.

Any access codes or passwords provided should be safeguarded at all times. You are responsible for the security of your access codes and passwords and will be solely liable for any use or unauthorized use of the Site or the App under such access codes or passwords

4. Charges, Payment and Returns

We attempt to be as accurate as possible. However, we do not warrant that the product descriptions on our Website are accurate, complete, reliable, current or error-free.

You tell us on your account page when you want us to ship a Box of items. The items in the Box are chosen by us, based on the information you provided.

Each Box may contain a variety of differently priced items and part of the experience of using the Service is the surprise you feel when opening the Box, we do not generally disclose the prices of the items in the Box before it is shipped. You will see the prices after the shipment.

Prior to shipping you a StyleBox, we will charge you a non-refundable “Styling Fee” in the amount set forth on the site main page. The Styling Fee will be charged to your credit card or other payment method between the time the order is placed and the time we ship your Box. Within three (3) days of receiving your Box, we request that you send back any Products you don’t want. If you choose to keep Products from your Box, the Styling Fee will be credited towards the purchase price of those Products. You may pay for any Products from your Box via credit card or other payment method then available on the Services. By submitting your payment information to us, you authorize us to charge your credit card or other payment method then available in accordance with these Terms. If you receive Boxes automatically, you agree that we may charge the Styling Fee to the card or other payment method on file on a recurring basis according to the frequency you selected until you cancel it by (i) updating the “Style Profile” page on your Account homepage when you log in, (ii) by emailing us at support@stylebox.us from the email address currently associated with your account, stating that you want to stop receiving automatic Boxes. You represent that you will not use any credit card or other form of payment unless you have all necessary authorization to do so. We will not be liable in the event your children or others acting with or without your permission use your credit card, PayPal account, or other means of payment to make orders on the Services; however, you may report any unauthorized use to us, and we will use reasonable measures within our control to help prevent future unauthorized use of your credit card or other payment method.

Sending Back Products During the Try-On Period.

Any Products sent back must be postmarked no later than three (3) days after you receive the package (the “Try-On Period”) and must be unworn and in the original condition. You will retain title to the Products and risk of loss of the Products will remain with you until we receive the Products and we determine that the Products were returned unworn and in their original condition, at which point you will be deemed to have rejected the Products and title will return to us. We will assume that you have chosen to keep any Products in the Fix that you do not postmark back to us by the end of the Try-On Period, and we will charge your Account for those Products any time after the end of the Try-On Period. Any exceptions permitting a return postmarked later than the end of the Try-On Period must be requested in a timely manner and may be granted at the sole discretion of StyleBox.

When you want to return items you fill the “Return” request on your order, and we will e-mail you the prepaid return label. You return items by placing them in your Box, attaching the return label and mailing them with the United States Postal Service

If you return merchandise that StyleBox in its discretion deems unsellable, damaged, worn, or with the tags removed we will charge your Account for those Products.

5. Shipping and Sales Taxes

When you request that we send you a Box, we will provide you with an anticipated shipping date. That is an estimated, not a guaranteed date, and the actual shipping date may vary in the ordinary course of business. We currently offer free shipping.

Sales tax applies to your purchases where we choose or are required to collect and remit such taxes.

6. The Subscription

StyleBox offers three Subscription plans: Every Month (orders are placed automatically each month), Every other Months (orders are placed automatically every two months), and Every 3 Months (orders are placed automatically every three months).

By registering for any subscription, you acknowledge that your subscription will be shipped to you according to your plan, and the price of the box will be charged before the shipment. It will be calculated based on items that will be selected and according to price preferences you’ve selected.

There are two price preferences: SMART (The total price of the box will be up to $350) and SMART LUX (The total price of the box will be up to $600). Each Box has on average 3 to 5 items, rarely few more.

Your subscription will be automatically extended for successive applicable periods and your payment method will automatically be charged for each successive applicable. To cancel or change your Subscription at any time, you must log on to your account and change the Box frequency to “Only by request” selection.

Changes to your subscription Frequency will not cancel any open orders. To cancel an order, you must email us.

We reserve the right to revoke your subscription at any time as a result of a violation of these Terms and Conditions or the Privacy Policy. Membership is void where prohibited by law.

7. Fraud Protection

As part of our order processing procedures, we may screen received orders for fraud or other types of unauthorized or illegal activity. We reserve the right to refuse to process an order due to suspected fraud or unauthorized or illegal activity. If we suspect fraudulent, unauthorized or illegal activity, we may reject your order or we may contact you at the phone number or email address you provided to confirm your order. We also reserve the right to cancel any accounts or refuse to ship to certain addresses due to suspected fraud or unauthorized or illegal activity. We take these measures to protect our customers as well as ourselves from fraud or other unauthorized or illegal activity.

8. Intellectual Property

Our Website is protected by U.S. and international copyright laws. You may not copy, distribute, upload, transmit, sell, display, disseminate, reproduce or use for commercial purposes any of the copyrighted information (including without limitation content, images, or trade dress) on our Website without receiving our prior written permission.

Subject to your compliance with these Terms of Service, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of our Website. This license does not include any resale or commercial use of the Website or its contents, any collection and use of any product stylings or listings, descriptions, or prices; any derivative use of our Website or its contents; any downloading, copying, or other use of account information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools.

When you post a comment, upload a photograph, rate an item, or otherwise interact with our Website, you by doing so grant us a perpetual, irrevocable, royalty-free, transferable right and license to use, modify, reproduce, transmit, publish, display, delete, and distribute that comment, rating or interaction on our Website or in other media.

All trademarks, logos, other marks, and trade dress pertaining to our Website and products are our property or belong to their respective owners. You may not use any such trademarks, logos, other marks or trade dress without our prior written consent or the consent of the owner, if not us.

9. Contributed Content Guidelines

StyleBox values your engagement. When contributing content, please consider the following guidelines:

  • By submitting or posting any materials or content on the Site or the App, you grant StyleBox a perpetual, irrevocable, non-terminable, worldwide, royalty-free and non-exclusive license to use, copy, distribute, publicly display, modify, create derivative works, and sublicense such materials or any part of such materials. You hereby represent, warrant and covenant that any materials you provide do not include anything (including, but not limited to, text, images, music or video) to which you do not have the full right to grant StyleBox the license specified above. You further represent, warrant and covenant that any materials you provide will not contain libelous or otherwise unlawful, abusive or obscene material. StyleBox will be entitled to use any content submitted by you without incurring obligations of confidentiality, attribution or compensation to you.
  • All contributed content is subject to the terms set forth below and in our standard Terms and Conditions, which include our policy regarding copyright infringement;

We reserve the right not to post your content if it contains any of the following types of content or violates other guidelines. By way of example, and not as a limitation, you agree that when contributing content, you will not:

  • Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;
  • Use obscenities, discriminatory language, or other language not suitable for a public forum;
  • Post advertisements, “spam” content, or references to other products, offers, or websites;
  • Post email addresses, URLs, phone numbers, physical addresses or other forms of contact information;
  • Post unduly critical or spiteful comments of other content posted on the page or its authors;
  • Post files that contain software or other material protected by intellectual property laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have expressly received all necessary consents;
  • Post files or content that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer;
  • Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded, or impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity;

10. Taxes

The total price will include applicable sales tax; such state and local sales tax is based on the shipping address and the sales tax rate in effect at the time you purchase the product. We will charge tax only in states where the goods sold over the internet are taxable.

THIS WEBSITE AND ALL INFORMATION, CONTENT, PRODUCTS, AND OTHER SERVICES INCLUDED ON OR MADE AVAILABLE TO YOU THROUGH THE WEBSITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE“ BASIS UNLESS OTHERWISE SPECIFIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
